Welcome to www.ciffco.com. This website, hereinafter referred to as the “Website”, is the property of the Centre International de Formation Ferroviaire de la Côte d’Opale (Côte d’Opale International Railway Training Centre), hereinafter referred to as “CIFFCO”, which operates it.

The terms and conditions set out below, hereinafter referred to as the “T&C”, govern the use of the Website. We ask you to read them carefully before using the Website, as using the Website constitutes your tacit acceptance of the T&C. If you do not accept these T&C, you must not use the Website.

CIFFCO reserves the right to amend these T&C, the Terms and Conditions of Sale and any other legal information documents available on the Website without prior notice. You agree to comply with these documents and to accept any changes as soon as you use the Website after publication thereon.

1. Intellectual property

The Website and its contents are subject to legal protection under intellectual property law.

CIFFCO is, unless otherwise stated, the holder of all the intellectual property rights attached thereto, as well as the exclusive licence holder of CIFFCO trademarks.

Accessing the Website does not transfer to the user any rights in relation to the Website or its contents. The only right of granted to you is that of access and is not in any way an assignment of the intellectual property rights attached thereto.

The trademarks, logos, illustrations, photographs, databases, graphic design elements, videos, audio content, page layouts and, more generally, all the content published on the Website, as well as its organisation, may not be reproduced, copied, disseminated, modified, transmitted, sold, published, adapted in any way, by any means whatsoever, on any medium whatsoever, in whole or in part, without receiving prior written consent from CIFFCO.

We strive to maintain the availability of this website 24 hours a day, but we may not be held liable for its malfunction, regardless of the reasons, time and duration thereof. Sometimes access to the Website may be temporarily interrupted without notice in the event of failure, maintenance or repair of the system, or for reasons beyond our control.

3. Terms of use of the Website

1. Acceptance and modification of the T&C

Use of this Website is subject to compliance with these T&C. You acknowledge that you have read this document before using the Website and you agree to comply with it.

CIFFCO reserves the right to modify these T&C without notice. Modifications are therefore enforceable against you as soon as they are posted on the Website. We ask you to check these conditions regularly and to comply with them when using the Website.

Legal provisions or notices expressly designated on specific pages of the Website may replace certain provisions provided for in these T&C.

2. Creating a user space

CIFFCO gives all users the option to create a user account in order to take advantage of the online products and services offered by CIFFCO.

All adults – more than 18 years old – have the facility to create a user space.

You agree to ensure that the information provided, which is necessary to create this space, is correct.

By logging into your user space, using a username and a password chosen during registration, you will be able to:

  • Benefit from the services offered by CIFFCO. Any purchase of these services will be subject to the terms and conditions of sale provided at the following link XXX;
  • Access training content and data;
  • Download training certificates;
  • Give your opinion on the quality of the training courses.

3. Content of the online training courses offered by CIFFCO

With the creation of your user space, you have the option to purchase, under the products and services offered by CIFFCO, online training services in accordance with the aforementioned terms and conditions of sale.

These online training courses contain different sequences such as:

  • Videos

The uploaded videos may be made by CIFFCO, by any subsidiary of Getlink or any contracting party of CIFFCO or one of the Getlink companies.

The videos may also come from third-party websites, which give third parties the facility to make some videos available to users of their own website through certain features such as “Embed”/ “Iframe”.

  • Exercises/assessments

The training courses offered by CIFFCO include knowledge validation exercises so that each user may check their understanding of the knowledge communicated through the online training courses.

  • Downloading content and certificates

The training courses offered allow users to download certain content. As a user, you have a limited non-exclusive right to use this content whilst following the training. The user accepts the content as is on the day of the training and may not hold CIFFCO liable for failure to update the training you have followed.

The user may also download his training certificate available on his user space.

  • A discussion space

Each user has the facility, within this discussion space, to ask questions or post comments related to the training followed.

4. Authorised uses/Unauthorised uses

As a user of the Website, CIFFCO gives you the facility to create a user space, buy a training course and follow it directly online and finally, publish content on the discussion forum.

These opportunities require you to agree to comply with the following rules regarding authorised uses and unauthorised uses.

  • Authorised uses

You agree to use the Website for lawful and appropriate purposes only and in particular to:

  • Use the features and services offered by the Website only for the purposes for which they are made available to you;
  • Ensure the confidentiality of your username and password, which are strictly personal;
  • Enter only accurate information;
  • Regularly update your information;
  • Comply with the regulations in force.
  • Unauthorised uses

Anything that is against the law is not allowed.

As a user, you must not:

  • Upload illegal or inappropriate content (political or religious opinions, indecent content, etc.);
  • If applicable, receive and/or distribute by any means whatsoever, all or part of the contents of the courses in which you are participating;
  • Publish or make accessible the answers to the assessments on any medium whatsoever;
  • Upload content that is defamatory;
  • Promote violence;
  • Promote illegal activity;
  • Use the website in a manner that violates any local, national or international law;
  • Use the website in a manner that is illegal, fraudulent or has an illegal or fraudulent purpose;
  • Knowingly transmit any data or send or download any material containing a virus, Trojan horses or any other spyware or adware that could be harmful;
  • Use the platform to knowingly send, receive, download, use or reuse any material that does not comply with the standards and provisions hereof.

With the exception of personally identifiable information, which is covered by our Privacy Notice [LINK], any material transmitted or sent to the Website shall be considered as non-confidential and free of rights and CIFFCO will then be able to use it freely, including copying, disclosing, incorporating and otherwise using this material and any data, image, sound, text and other elements contained in this material for any commercial or non-commercial purposes.

5. Illegal content

The user is criminally liable for the information he posts on the Website’s discussion space and, in particular, content provoking or glorifying crimes, offences or acts of terrorism, inciting hatred or discrimination or which has the effect of harming people’s private lives or reputations. These offences, if convicted, can be punished by up to 7 years’ imprisonment or a fine not exceeding the statutory maximum (100 000 euros) or to both, (article 23 to 41-1 of Loi Française sur la liberté de la Presse du 29 juillet 1881 and article 421-2-5 of French Code penal).

CIFFCO implements post-publication moderation of content uploaded by any user.

Moderation may result in the blocking of the user’s access to the Website, without prejudice to any criminal and/or disciplinary proceedings if the user is an employee of one of Getlink’s subsidiaries and in cases where CIFFCO finds that illegal content has been published.

CIFCCO has set up a procedure for reporting illegal content posted by users. This feature is accessible from the “report” button in the discussion space.

CIFFCO retains all the data that gave rise to a report for a period of one year from the notification date.

6. Limitation of liability
